Terms of Service

These Terms of Service ("Terms") govern your use of Mobile Service OS (the "Service"), operated by Mobile Service OS ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You may use the Service if:

• You are at least 18 years old.
• You are operating a legitimate mobile tire, roadside, or related service business.
• You have the legal authority to bind your business to these Terms.
• You are not barred from using the Service under applicable laws.

2. Account responsibilities

You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account.
• Ensuring information you enter is accurate.
• Notifying us promptly of any unauthorized access.

3. Customer data you enter

When you log jobs and invoices in the Service, you may enter personal information about your customers (names, phone numbers, addresses, vehicles, photos). You warrant that:

• You have a lawful basis to collect and store this information.
• You have notified your customers of your privacy practices as required by applicable law.
• You will respond to your customers' data requests (access, deletion, correction) within the timeframe applicable law requires.

We act as a data processor on your behalf for this information. See our Privacy Policy for details.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or to violate any law.
• Misuse the Service to harass, defraud, or harm others.
• Attempt to gain unauthorized access to other users' accounts or data.
• Interfere with the Service's operation, including by submitting malicious code or excessive load.
• Reverse engineer, decompile, or attempt to extract the source code of the Service except where applicable law expressly permits.
• Resell or sublicense the Service to third parties without our written consent.

5. Founder Access & subscription

During Founder Access, the full Pro feature set is unlocked at no charge. Founding Members lock in a founder rate (69% off the standard plan price for the first 12 months) which applies to their account when paid plans begin. You will be notified before any billing starts and nothing is charged to a payment method you have not entered.

When paid plans begin and you choose to subscribe:

• Subscriptions are billed monthly in advance via Stripe.
• The price displayed at checkout is the price you will be charged for the current billing cycle.
• Subscriptions renew automatically unless cancelled.
• You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing cycle.
• We do not provide refunds for partial billing cycles unless required by applicable law.

6. Price changes

We may change the standard subscription pricing at any time. If we change the price for an existing subscriber, we will notify you at least 30 days in advance. Your Founding Member rate (if applicable) is preserved during the founder rate period; the price change applies to the period after that rate expires.

7. Ownership

The Service, including its software, design, and content (excluding data you enter), is owned by us and protected by intellectual property law. These Terms do not transfer any ownership rights to you. You retain ownership of the data you enter into the Service.

8. Data export & account deletion

You may request a copy of your data or deletion of your account at any time by emailing info@mobileserviceos.app. We will fulfill the request within a reasonable period (typically 30 days), subject to any legal obligations that require us to retain certain records.

9. Service availability

We aim to keep the Service available and reliable, but we do not guarantee uninterrupted operation. The Service may be unavailable from time to time for maintenance, updates, or due to factors beyond our control (network outages, third-party service failures, etc.).

10. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT DATA WILL BE PRESERVED WITHOUT LOSS.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of:

• Your use of the Service.
• Your violation of these Terms.
• Your violation of any third-party right, including the rights of your customers.
• The data you enter into the Service.

13. Termination

You may close your account at any time. We may suspend or terminate your account if you violate these Terms, if your subscription payment fails and is not cured within a reasonable period, or if we discontinue the Service. On termination, the licenses granted to you under these Terms end, and we will delete or return your data as described in Section 8.

14. Governing law & disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws principles. Any dispute arising out of these Terms or the Service will be resolved in the state or federal courts located in Broward County, Florida, and you consent to the jurisdiction of those courts.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you via the email address associated with your account or via a notice within the Service at least 30 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
